Types of Mark Can be Applied for Trademark Registration

The following unique identity marks can be applied for trademark registration in India. There are many types of marks, but the most popular ones are Wordmark and Device Mark.

Wordmark: Simple Word(s) or Tradenames. These are considered the highest protected marks, as no one can use such names with or without a logo or image, etc.

Device (Logo): Visual Character Marks. These include logos, symbols, shapes, graphics, etc.

Trademark Registration Process - Flowchart of Trademark Application

Step 1: Filing of TM Application

After conducting a pre-check of existing marks, and based on the documents and details provided by you, we will proceed to file the trademark application with the registrar.

Step 2: Formality Checkpass

The Trademark Portal will initiate a formality check and will send for corrections if any primary errors are found in the application.

Step 3: Examination of Mark

After that, the mark will be examined by the trademark authority. If they find the mark to be unique and distinguishable, it will be accepted. Otherwise, it will undergo an Examination Report and require a response.

Step 4: Response to Examination Report

If the applicant receives a Trademark Examination Report containing queries under Section 9(1)(a), 9(1)(b), or 11, a response to the Examination Report is required to be submitted. Subsequently, there are two possibilities: 1. The mark is accepted, or 2. The mark proceeds to the hearing procedure. Step 5: Hearing Procedure and Journal Publication

If the mark proceeds to a hearing, the hearing will be conducted (both online and offline hearing modes are available). Following the completion of the hearing, there are two possibilities: 1. Acceptance of the mark, or 2. Refusal. If the mark is accepted, it will appear in the Trademark Journal.

Step 6: Final Approval, Mark Considered as Registered

After the completion of 120 days of journal publishing, the mark is considered as registered. If the mark receives any opposition, it will proceed to opposition hearing.

Trademark registration is required to obtain activity and category-wise classification. This means that if a client provides multiple activities, products, or services under the same trade name or mark, separate trademark applications must be filed for each relevant class and category of product.
